Constitution 2

Several months ago I wrote about the Japanese Liberal Democratic Party‘s latest proposal for the revision of their country’s constitution. I have been studying that proposal more carefully in recent weeks, as I am preparing an afterword for my 2006 book, The Constitution is a Command to the Government.¡¡In this column I want to share with the readers some of the things I have learned from that study, as I think it may be important for Korean people to know what is happening in their neighboring country.

The Japanese Constitution, seen as an event of the immediate postwar period, seized power from the Government of the Greater Japanese Empire (ÓÞìíÜâð¨ÏÐïÙݤ) and handed it to the Japanese people. Since its foundation the Liberal Democratic Party has wanted that power back, and the people have refused to give it to them. The present Constitutional Amendment Proposal (í»ÚÅÓÚúÊÛöËÇïáõ®äÐ) is designed to seize that power back from the people. To get a constitutional amendment proposal through the Diet requires a 2/3 majority. Given the present popularity of the LDP, they may get it.

This amended Constitution (actually, a completely new constitution) will change the status of the Emperor. Article 1 will proclaim the Emperor “the head of state”. Article 3, which presently requires the Emperor to seek the “advice and approval” of the cabinet for all acts of state, will have the word “approval” removed. Article 4 presently states, “The Emperor shall perform only such acts in matters of state as are provided for in this Constitution”; it will have the word “only” removed. And, as I wrote last time, the final article of the Constitution, which lists the government officials who are obligated to “respect and uphold” the Constitution, will have “Emperor or Regent” removed from that list. Put simply, while the present Constitution placed the Emperor within the framework, and under the control, of the law, the new constitution will place him back outside that framework.

As I also wrote last time, while the present Constitution grants human rights unconditionally, saying only that they should be used for the public welfare, the new constitution will add that they must not upset “public order”. This changes human rights from absolute guarantees to something that can be allowed to the people just so long as they don‘t inconvenience the government. In addition, the new constitution will establish a “state of emergency” condition during which human rights can be suspended altogether and everyone will be obligated to obey the commands of the Prime Minister.

And of course, the new constitution will restore to the government the Right of Belligerency, which Article 9 has denied it. That means that Japanese soldiers will again have the right to kill people in wars without it being considered murder.

I also wrote in my earlier column that the “speaker”, the “voice” in the present Constitution is clearly the Japanese people, but that in the proposed constitution the speaker is unclear. I think I have since been able to identify that speaker. It is the Liberal Democratic Party leaders. You can recognize them in both the content and the tone of the proposal. As for content, the proposal contains not only their political thinking, but also their typical stock phrases, their aesthetic tastes, their prejudices, their particular passions, their notion of history, the issues they like to emphasize and the blank spaces that represent the issues they want to avoid. As for the tone, one can recognize the LDP voice in its boastfulness, its irritability, its anger, its occasional lack of confidence, and its deep mistrust of the Japanese people. This mistrust of the people is perhaps the surest proof that the speaker - the sovereign voice - is not the people, but rather the LDP. The new language inserted as Article 102 - “All the people must respect this Constitution” - can surely not be understood as the sovereign commanding itself.

It is not surprising that the LDP is angry with and mistrustful of the people. For while the people have elected the LDP to be the Government consistently since the end of the war, they have not given it free reign, but rather have put limits on its activities. Surely the most irritating thing for the LDP was being prevented by the people, year after year, from amending the Constitution. The present constitutional proposal seems to be designed as their punishment.

ÀڹδçÀº À۳⿡ ¿¹Àü °Íº¸´Ù ÈξÀ »ó¼¼ÇÑ »õ·Î¿î Çå¹ý¾ÈÀ» ¹ßÇ¥Çß´Ù. ¿À·§µ¿¾È Çå¹ý°³Á¤À» °ø°ø¿¬ÇÏ°Ô ÁÖÀåÇØ¿Â ¾Æº£ ½ÅÁ¶ ½ÅÀÓ ÃѸ®°¡ »õ Çå¹ý¾È ¸¶·Ã¿¡ ÁÖµµÀûÀ¸·Î Âü¿©Çß´Ù. ÀÌ Çå¹ý¾ÈÀ» µé¿©´Ùº¸¸é ¾Æº£¿Í ÀڹδçÀÌ ¾î¶² ¸ð½ÀÀÇ ‘ÀϺ»’À» ÀçâÁ¶Çس»·Á´ÂÁö ¾Ë ¼ö ÀÖ´Ù.

¹®Á¦´Â Çå¹ý¾È Àü¹®¿¡¼­ºÎÅÍ ½ÃÀ۵ȴÙ. ÇöÇà Çå¹ý Àü¹®ÀÇ Ã¹ ¹®ÀåÀº ‘ÀϺ» ±¹¹ÎÀº’À¸·Î ½ÃÀÛÇØ ‘ÀÌ Çå¹ýÀ» È®Á¤ÇÑ´Ù’·Î ³¡³­´Ù. µû¶ó¼­ ÀÌ ¹®°ÇÀÇ ÁÖü´Â ‘±¹¹Î’ÀÌ´Ù. ¸ÞÀÌÁö Çå¹ýÀÇ ÁÖü´Â ‘Áü(õȲ)’À̾ú´Ù. ÇöÇà Çå¹ýÀº º¸Àå¹Þ¾Æ¾ß ÇÒ ÀαÇÀÇ ±ä ¸ñ·ÏÀ» ´ã°í ÀÖ´Ù. ÀαÇÀº ‘°ø°øº¹¸®¸¦ À§ÇÑ´Ù’´Â Á¶°ÇÇÏ¿¡¼­¸¸ Á¦¾àµÉ ¼ö ÀÖ´Ù. Àڹδç Çå¹ý¾ÈÀº ‘°ø°øÁú¼­’¸¦ ÇØÄ¡´Â °æ¿ì¿¡µµ ÀαÇÀÌ Á¦¾àµÉ ¼ö ÀÖ´Ù°í Ãß°¡ÇÏ°í ÀÖ´Ù. ¸ÞÀÌÁö Çå¹ý¿¡µµ ¶È°°Àº À뱂 Á¦¾à Á¶Ç×ÀÌ ÀÖ¾ú´Ù. ‘º¹¸®’¿Í ‘Áú¼­’´Â ´Ù¸¥ °³³äÀÌ´Ù. °¡·É ÀϺ»ÀÇ 1960³â´ë ¾Èº¸Á¶¾à ¹Ý´ëÅõÀïÀº °ø°øº¹¸®¸¦ ÁÖÀåÇ߱⿡ ÇöÇà Çå¹ýÇÏ¿¡¼­ Çã¿ëµÇ´Â ÇàÀ§¿´´Ù.
